J. E. Fourie Occupational Health and Safety Consultants functions as an established Occupational Health, Safety & Environmental service provider to mainly the Construction Industry within South Africa.
With the Promulgation of the Construction Regulations of 2003 and the existence of the OSH Act, Act 85 of 1993, clients and principal contractors have now been forced to adhere to these legal requirements in order to make the construction industry a safer, better and more profitable industry for all role players involved.
Being part of this process and also understanding the responsibilities of both clients and contractors Jaco Fourie saw the need to aid employers in the maize of legislation that impacts every project.
Occupational Health & Safety is still a relatively new concept to the Construction Industry and we as J. E. For us it is imperative that a sound relationship is maintained amongst all parties involved to ensure the effective implementation of Health, safety & Environmental Management Systems on contracts.
J. E. Fourie OHS Consultants specializes in the implementation and maintenance of Health & Safety Management Systems for the duration of Construction Contracts. With extensive experience in the Skills Development Training arena, we also plan and manage Skills Development Training Programs for the duration of contracts.
What does all this entail? After receiving the Safety Spec and the Contract document from the client we do the following:
1. SAFETY MANAGEMENT SYSTEM: The system has an implementation as well as a maintenance phase.
Administration: (Contract Specific)
- Registering contract with Dept of Labour
- Compiling SHE policy
- Compiling Safety management plan
- Confirming good standing with Workmen’s Compensation Commission
- Compiling Hazard Identification and Risk Assessments
- Compiling Safe Work Procedures from Risk Assessments
- Compiling and Completing all applicable Safety Appointments
- Compiling Toolbox talk program
- Compiling Aids awareness program
- Compiling Emergency procedures & program
Physical Implementation on site:
- Deploying qualified full time Contract Safety Representative on site..
- Establishing and activating Safety Committee (if applicable)
- Erecting of mandatory safety sign boards
- Implementing all applicable safety registers
- Establishing First Aid & Fire Fighting Capability on site
- Safety Induction to all on site
- Competency assessment and certification of all plant operators and drivers on site
- Confirming (Principal Contractor) adequate sanitation and ablution facilities on site
- Confirming pre shift checklists are in place
- Inspection and certification of all Vehicles and Plant in accordance with safety plan
- Daily Safety Inspections/ Checks by Safety Representative
- Monthly safety committee meetings when applicable (Chaired by Contract Safety Consultant)
- Monthly Safety Audits (Done by Jaco Fourie, a Qualified HSE Auditor)
- Weekly Safety Visits to the Site by Contract Safety Consultant.
- Continuous liaison and communication with Client, Resident Engineer and the Contract Manager.
- Monthly Safety Report to the Client, Resident Engineer and Principle Contractor
- Monthly Safety committee minutes to Client, Resident Engineer and Principle Contractor (when applicable)
2. HSE AUDITING:
Jaco Fourie being a qualified Auditor with extensive experience in the Road Construction Sector also functions as independent HSE Auditor for Clients and Principle Contractors. This includes Monthly HSE Audits and Audit Reports.
J. E. Fourie OHS Consultants will assist the Principle Contractor in bookings of with regard to training programs when needed.

COMPANY BACKGROUND:
In terms of current Health and Safety Legislation all employers must manage the workplace in such a way as to, amongst others:
· provide and maintain a safe, healthy working environment;
· ensure workers’ health and safety by providing
o information,
o instructions,
o training,
o supervision,
o prescribed PPE (Personal Protective Equipment).
· ensure that the required health and safety functionaries and representatives are appointed and
trained in order to comply with the relative regulations in the handling of -
o incidents,
o inspections,
o investigations, and
o inquiries,
o keeping of prescribed registers.
Self-employed people must ensure that they, their workers, or others are not exposed to health or safety risks.
Reporting Incidents
Employers must report to an inspector incidents in which -
· people are killed, injured, or become ill,
· dangerous substances are released, or
· machinery fails or runs out of control.
From the above summary and through practical experience on site, it is clear that managers allover are finding it increasingly difficult to include Health and Safety management with their other Key Performance Areas. Because of this, Health and Safety is understandably often deemed as of lesser importance than production. It is important however to realise that, apart from being mandatory, compliance with legislation is also to the advantage of the employer in cases of labour disputes or workplace related claims.
